Delaware Proposes Allowing Marijuana Growers to Make and Sell Their Own Pre-Rolls

Delaware marijuana growers would be allowed to manufacture pre-rolls using their own flower and sell them to licensed retailers under regulations proposed by the Office of the Marijuana Commissioner.

The proposal, published in the September 1 Delaware Register of Regulations, would expand cultivation facilities’ authorized activities while placing specific restrictions on production and branding.

Growers could produce pre-rolls bearing their own facility’s branding, but could not manufacture them for third parties or market them under another brand. They would also be prohibited from purchasing flower from other marijuana businesses to make pre-rolls or producing versions containing concentrates or kief.

The changes would authorize growers to package and label the pre-rolls for wholesale distribution. Direct sales to consumers would remain prohibited under cultivation licenses.

The package also proposes revisions to align packaging restrictions with earlier changes governing allowable colors and imagery.

Written comments will be accepted through October 1 at OMC@delaware.gov. Regulators could decide whether to adopt or revise the proposal on or after October 2.

If adopted, the amendments would take effect 10 days after publication as final regulations in the Delaware Register.
